Yes, you are supposed to leave it there. If someone attacks you with a gun and you kill them in self defense, you do not suddenly own their gun and clothes etc. It would go to the police, and theoretically it's the same in Elite. Obviously it's way more fun to scoop up what they had as far as playing a game goes.
